These Terms of Use (“Terms”) govern your use of Sober MP3 Player (the “App”), operated by Nzenlabs (“we”, “us”, or “our”), with our place of business in the Republic of Korea. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, solely for personal, non-commercial use, subject to these Terms and applicable app store rules.

The App, including its design, code, and branding, is owned by Nzenlabs and protected by intellectual property laws. These Terms do not sell or transfer any ownership rights to you.

2. Apple App Store and Standard EULA

If you obtained the App through the Apple App Store, your use is also subject to Apple’s Licensed Application End User License Agreement (“Apple Standard EULA”): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Where Apple’s Standard EULA and these Terms conflict regarding Apple-distributed copies, Apple’s Standard EULA controls for that conflict only.

3. Eligibility

You must be at least 13 years old to use the App. If you are under the age required to consent in your country, you may use the App only with permission from a parent or legal guardian.

4. Local Storage and Your Content

The App is a standalone, local media player. Audio files you import, playlists, playback statistics, and related data are stored on your device within the app’s sandbox. We do not host, monitor, or access your music files on our servers.

You are solely responsible for the legality of the audio files you import, including copyright and licensing. You must not use the App to play or distribute content you do not have the right to use.

Local app data is generally removed when you uninstall the App, subject to your device/OS backup or restore settings. You are responsible for maintaining your own backups.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose;
• Reverse engineer, decompile, or attempt to extract source code except where law permits;
• Interfere with the App’s operation or circumvent security features;
• Redistribute, sublicense, or resell the App except as allowed by applicable law.

7. External Links

The App may open external web pages (for example, our website, Privacy Policy, or these Terms) when you choose those links. We are not responsible for third-party websites or their content.

8. In-App Purchases

The current version of the App does not offer in-app purchases. If we add purchases in a future update, additional terms and Apple’s payment policies will apply.

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NZENLABS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ZERO (USD 0), IF THE APP WAS PROVIDED FREE OF CHARGE.

11. Apple-Specific Terms

If you obtained the App from the Apple App Store, you acknowledge that these Terms are between you and Nzenlabs only, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App.

To the extent permitted by applicable law, Apple will have the right to enforce these Terms against you as a third-party beneficiary of the license granted to you through the App Store.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last Updated” date. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

13. Termination

You may stop using the App at any time by uninstalling it. We may discontinue or modify the App at any time without liability, to the extent permitted by law.

14. Governing Law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law principles. Courts in the Republic of Korea shall have exclusive jurisdiction over disputes arising from these Terms, unless mandatory law requires otherwise.
